Language Access in the Workforce: A Federal Mandate, A Human Imperative

In today’s rapidly evolving workforce landscape, one issue is rising from the margins to the main stage: language access.



At the 2025 National Workforce Conference, I have the privilege of leading a powerful session on this critical topic—one that impacts compliance, safety, productivity, and ultimately, people. As the CEO of Aha! Workforce Education Solutions, I’ve spent decades in the trenches—supporting job seekers, training employers, and advising government entities on how to ensure their workforce policies include everyone.

This conversation is no longer optional. It is mandated, measurable, and deeply tied to our national workforce performance.


The Numbers Speak for Themselves

According to the U.S. Census Bureau’s 2022 American Community Survey:

  • Over 68 million U.S. residents speak a language other than English at home.

  • More than 25.6 million people are classified as Limited English Proficient (LEP).

  • That represents nearly 1 in 11 Americans—all of whom may be in your workforce, applying for your services, or navigating your programs.


This is not a small demographic—it’s a significant portion of our labor force. And yet, many organizations remain underprepared to communicate with and support these individuals effectively.


New Federal Guidance Demands Action

In December 2023, the Department of Justice and the U.S. Department of Labor jointly reaffirmed the importance of language access under Title VI of the Civil Rights Act of 1964. Their updated guidance made it crystal clear:

Any organization receiving federal funding must provide meaningful access to LEP individuals.(Source: DOJ & DOL Joint Language Access Guidance, 2023)

Then in March 2024, the White House Office of Management and Budget issued Memorandum M-24-08, titled “Strengthening Access to Federal Programs and Services for LEP Individuals.”This memo emphasized:


  • The need for updated and enforced language access plans

  • Ongoing staff training and tracking of compliance efforts

  • Agency-wide responsibility to serve LEP individuals effectively(Source: www.whitehouse.gov/omb, M-24-08)


These aren't recommendations. They're expectations. And failure to comply isn't just a reputational risk—it's a legal one.


Why This Matters to Everyone

Whether you’re a government agency, an apprenticeship sponsor, a nonprofit, or a business owner—this is about more than compliance. It's about ensuring safety, accuracy, and dignity in every workforce interaction.


Language access:

  • Prevents workplace accidents and legal misunderstandings

  • Improves employee retention and engagement

  • Ensures programs reach those they are designed to serve

  • Reinforces public trust and organizational credibility


And perhaps most importantly—it opens doors for individuals who have long been navigating the system in silence.
